Taverna Interactive reserves the right to change or modify any terms and conditions contained in the Terms of Service or any policy or guideline of any Taverna Products, at any time and in its sole discretion. In case of any changes to the Terms of Service or any of its associated or referred documents, the date when these changes or updates happened will be indicated at the top of the Terms of Service document. By agreeing to these Terms of Service, you understand that Taverna Interactive will do its best to warn its users and clients whenever there is a change to the Terms of Service, but it is the user's sole responsibility to check for any modifications to the Terms of Service before accessing or using any Taverna Product. Any changes will take effect immediately upon posting of the revisions on the applicable Taverna Products. By using any Taverna Products after any changes to their corresponding Terms of Service, you expressly agree to be bound by the new version of the Terms of Service. Therefore, you agree to review the Terms of Service and applicable policies whenever you use any Taverna Products, in order to determine whether such terms have been modified, and to understand the terms and conditions that apply to your use of any Taverna Products. Taverna Products may include Interactive Areas or Interactive Services (as defined in the Glossary section of this document). By agreeing to this Terms of Service, you are solely responsible for your use of such Interactive Areas and use them at your own risk. By using any of the Taverna Products, you represent and warrant that you have the lawful right to distribute and reproduce such User Content. Taverna Interactive reserves the right to monitor, edit, hide or remove any User Content that you or any other users provide in any Interactive Area of any Taverna Product, at any time and without notice. You are solely responsible for creating backup copies and replacing any User Content you post or store on the Taverna Products at your sole cost and expense.
If you post User Content to the Taverna Products, you grant Taverna Interactive and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content throughout the world in any media, as well as the right to use the name that you submit in connection with such User Content.
For using some of Taverna Products, you might be required to download, install and/or use certain third party softwares, including, and not limited to: client softwares, libraries or browser plugins. These softwares might be provided through the Taverna Products. Your download, installation and use of these third party softwares is subject to, and you hereby agree to, the terms and conditions of any end user license agreement ("EULA") that accompanies such third party softwares, as well as these Terms of Service.
Taverna Products might provide Third Party Content and Third Party Applications as a service to its users. Taverna Interactive does no monitor or have any control over, and is not responsible or liable for, any Third Party Content or Third Party Applications. Third Party Content and Third Party Applications are provided "AS-IS," and Taverna Interactive does not endorse or sponsor any Third Party Content or Third Party Applications. Taverna Interactive does not make any kind of representation or warranties to Third Party Content or Third Party Applications, including, and not limited to: content, functionality, accuracy, completeness, fitness for a particular purpose, merchantability, legality or safety thereof. Users use the Third Party Content and Third Party Applications contained therein at their own risk.
Unless otherwise indicated, the Taverna Products, its contents and all the contents available throught Taverna Products, are the proprietary property of Taverna Interactive or its licensors and are protected by international copyright laws. You are granted a limited, non-sublicensable license to access and use the Taverna Products for your non-commercial and personal use only. Such license is subject to these Terms of Service and does not include:
Any use of the Taverna Products or their contents other than as specifically authorized herein, without prior written permission of Taverna Interactive, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws. Except as explicitly stated herein, nothing in these Terms of Service shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time.
Taverna Interactive may run advertisements and promotions from third parties on the Taverna Products. Your business dealings, relationships and correspondence with, or participation in promotions of, advertisers other than Taverna Interactive, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. Taverna Interactive is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Taverna Products.
You may be allowed access to new or revised portions of a Taverna Product for the purposes of Alpha or Beta Testing. In such cases, you will receive a status of "Tester", and you agree to use the Taverna Product in accordance to the terms described in this section of the Terms of Service document.
As a Tester, you are given access to one or more Taverna Products for the sole purpose of evaluating an alpha or beta version of it, to provide feedback and help identifying errors.
The Tester agrees to and does hereby assign to Taverna Interactive all rights throgout the world, including without limitation copyright, trade secret rights and the right to patent, in any invention, improvement, idea or know-how (whether or not patentable) that is conceived, learned or reduced to practice in the context of Tester's use of any Taverna Product including without limitation all suggestions, comments, improvements, bug-fixes and other information that you report to Taverna Interactive.
As a Tester, you also understand that all data created, accumulated, stored or manipulated on or through the Taverna Products by you, including - but not limited to - Virtual Goods and/or Currencies, may be lost or reset at any time. Also, you acknowledge that a Taverna Product or portion thereof in an alpha or beta test version may contain bugs, performance defects and other anomalies.
Taverna Interactive disclaims all warranties relating to any Taverna Products, express or implied, including, but not limited to, any warranties against infringement of third-party rights, merchantability and fitness for a particular purpose.
Taverna Interactive reserves the right to run contests and promotions for or in connection with Taverna Products. The rules for such contests and promotions will be provided through the Taverna Products where they occur. You agree to read and abide by the rules of the contests or promotions you wish participate. Taverna Interactive also reserves the right to modify the rules or policies of contests and promotions of Taverna Products, at any time and at its sole discretion.
EXCEPT AS EXPRESSLY PROVIDED TO THE CONTRARY IN A WRITING BY TAVERNA INTERACTIVE, THE TAVERNA PRODUCTS ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TAVERNA INTERACTIVE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AS TO THE TAVERNA PRODUCTS AND THEIR CONTENTS, INCLUDING WITHOUT LIMITATION ANY THIRD PARTY SOFTWARE, THIRD PARTY CONTENT AND THIRD PARTY APPLICATIONS. TAVERNA INTERACTIVE DOES NOT REPRESENT OR WARRANT THAT TAVERNA PRODUCTS OR THEIR CONTENTS ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE.
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. TAVERNA INTERACTIVE IS NOT RESPONSIBLE FOR THE ACTIONS OF ANY THIRD PARTIES WHO MAY ACCESS THE SITE OR USE THE TAVERNA PRODUCTS, AND YOUR USE OF THE TAVERNA PRODUCTS IS AT YOUR OWN RISK.
TAVERNA INTERACTIVE IS NOT RESPONSIBLE FOR TYPOGRAPHICAL ERRORS OR OMISSIONS. WHILE TAVERNA INTERACTIVE ATTEMPTS TO MAKE YOUR ACCESS AND USE OF THE TAVERNA PRODUCTS SAFE, TAVERNA INTERACTIVE CANNOT AND DOES NOT REPRESENT OR WARRANT THAT THE TAVERNA PRODUCTS, ITS SERVER(S), THE THIRD PARTY SOFTWARES, APPLICATIONS OR OTHER SITE CONTENTS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; THEREFORE, YOU SHOULD USE INDUSTRY-RECOGNIZED SOFTWARE TO DETECT AND DISINFECT VIRUSES FROM ANY DOWNLOAD.
Taverna Interactive reserves the right to change, cancel or delete any and all content contained in the Taverna Products at any time without notice. This includes without limitation any levels, rankings, scores, points, game play history, application data, or public recognition you may have achieved or attained.
IN NO EVENT SHALL TAVERNA INTERACTIVE, ITS PARENTS, SUBSIDIARIES, AFFILIATES, LICENSORS, AND DEVELOPERS OR ANY OF THEIR DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES OR AGENTS (COLLECTIVELY, "TAVERNA ENTITIES") BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF ANY TAVERNA PRODUCT OR OTHER MATERIALS CONTAINED IN OR ACCESSED THROUGH THE TAVERNA PRODUCTS, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY USER ON ANY INFORMATION OBTAINED FROM TAVERNA PRODUCTS, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF PROFILES OR MESSAGES, CANCELLATION OF SAVED GAMES, CHANGES TO OR DELETION OF GAME SCORES OR RANKINGS, THE PROCESS OF MATCHING USERS TO PLAY MULTIPLAYER GAMES OR ENGAGE IN OTHER MULTI-USER ACTIVITIES, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO TAVERNA INTERACTIVE'S ONLINE RECORDS, PROGRAMS OR SERVICES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF TAVERNA INTERACTIVE AND ANY OF THE TAVERNA ENTITIES, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF THE TAVERNA PRODUCTS EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO TAVERNA INTERACTIVE FOR ACCESS TO OR USE OF THE TAVERNA PRODUCTS.
Taverna Interactive reserves the right to terminate your license to use any or all of the Taverna Products, and to block or prevent your future access to and use of any or all of the Taverna Products, without notice and at its sole discretion.
In case any provision of these Terms of Service shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions.
